This Privacy Policy explains how My No Diet Diet ("MNDD," "we," "us," or "our") collects, uses, shares, and protects information about you when you visit www.mynodietdiet.com, sign up for our free Binge Reset Audio, enroll in The Fullness Reset Method™, attend our webinars, interact with us on social media, or otherwise engage with our services (collectively, the "Services").

We are committed to protecting your privacy and complying with the EU General Data Protection Regulation (GDPR), the California Consumer Privacy Act / California Privacy Rights Act (CCPA/CPRA), the Washington My Health My Data Act, and the privacy laws of Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, and other applicable jurisdictions.

If you do not agree with this Policy, please do not use our Services.

1. Who We Are (Data Controller)

My No Diet Diet is registered in the Netherlands and operated from Italy. The Colorado address is a mail-forwarding address used for correspondence with US customers and does not represent a separate legal entity.

2. Information We Collect

We collect the following categories of personal information:

Information you provide directly:

• Name, email address, and phone number (when you sign up for the Binge Reset Audio, our newsletter, webinars, or programs)
• Billing and payment information (processed by Kajabi Payments and its underlying processors — we do not store full card details)
• Account credentials for The Fullness Reset Method™
• Information you share in coaching forms, intake questionnaires, or program submissions, which may include details about your eating patterns, weight history, emotional state, and wellbeing goals
• Messages you send via Instagram DM, ManyChat, email, or our contact forms

Information collected automatically:

• IP address, device type, browser, operating system, referring URL, pages visited, time on site
• Cookies, pixels, and similar tracking technologies (see Section 8)
• Engagement data from emails (opens, clicks)
• Webinar registration and attendance data

Information from third parties:

• Social media platforms (Instagram, Facebook) when you interact with our content or click ads
• Analytics and advertising partners (Meta)
• Affiliates or referral partners (where applicable)

Sensitive / Health-Related Information

Because our program addresses overeating, emotional eating, and behavioral change through hypnotherapy, some information you share may be considered sensitive personal information or consumer health data under GDPR (Art. 9), CPRA, and the Washington My Health My Data Act. We process this data only with your explicit consent and only for the purpose of delivering the program you signed up for. You may withdraw consent at any time.

3. How We Use Your Information (Purposes & Legal Bases)

We do not sell your personal information for money. Under California law, sharing data with advertising partners (e.g., Meta) for cross-context behavioral advertising may qualify as "sharing." You can opt out — see Section 10.

4. Who We Share Your Information With

We share personal information only with the following categories of service providers and partners:

• Kajabi (USA) — course hosting, account management, email delivery
• Kajabi Payments and its underlying processors (Stripe and Klarna) (USA / EU) — payment processing, including credit cards, Apple Pay, Google Pay, and Buy Now Pay Later
• ManyChat (USA) — Instagram DM automation and lead-magnet delivery
• Meta / Facebook / Instagram (USA) — advertising and pixel tracking
• WebinarJam / EverWebinar (USA) — webinar delivery and webinar-related emails
• Zapier (USA) — workflow automation between our tools
• Professional advisors — accountants, lawyers, tax advisors (under confidentiality)
• Authorities — when legally required

We do not sell your personal information to data brokers.

5. International Data Transfers

Our business is established in the Netherlands and operated from Italy. Most of our service providers are located in the United States. When we transfer personal data from the EU/EEA or the UK to the US or other countries outside the EEA, we rely on:

• The EU–US Data Privacy Framework (where the recipient is certified), or
• Standard Contractual Clauses (SCCs) approved by the European Commission, and
• Supplementary measures where required by the Schrems II ruling.

6. How Long We Keep Your Information

• Active customers and program participants: for the duration of your account plus 7 years for tax and legal compliance (Dutch accounting requirements).
• Newsletter subscribers: until you unsubscribe, plus a short suppression period.
• Webinar registrants who don't enroll: 24 months, then deleted.
• Cookie data: see our Cookie Banner for specific durations.
• Sensitive coaching/health data: deleted within 12 months after program completion, unless you request earlier deletion or longer retention.

7. Your Rights

Depending on where you live, you have some or all of the following rights:

If you are in the EU, EEA, UK, or Switzerland (GDPR / UK GDPR)

• Access — get a copy of your data
• Rectification — correct inaccurate data
• Erasure ("right to be forgotten")
• Restriction of processing
• Data portability
• Objection to processing based on legitimate interest or direct marketing
• Withdraw consent at any time
• Lodge a complaint with your supervisory authority. Because our business is registered in the Netherlands, the lead authority is the Dutch Data Protection Authority (Autoriteit Persoonsgegevens), www.autoriteitpersoonsgegevens.nl. You may also contact your local supervisory authority.

If you are in California (CCPA/CPRA)

• Right to know what we collect, use, share
• Right to delete
• Right to correct
• Right to opt out of sharing for cross-context behavioral advertising
• Right to limit use of sensitive personal information
• Right to non-discrimination for exercising your rights

If you are in Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, or another US state with a comprehensive privacy law

You generally have rights to access, delete, correct, and opt out of targeted advertising and sale of personal data. We honor universal opt-out signals (such as Global Privacy Control / GPC) where required.

If you are in Washington State (My Health My Data Act)

You have additional rights regarding consumer health data, including the right to withdraw consent and have your health data deleted.

To exercise any right, email us at [email protected]. We will respond within 30 days (GDPR) or 45 days (US laws). We may need to verify your identity. You can also designate an authorized agent.

8. Cookies and Tracking Technologies

We use:

• Strictly necessary cookies (always on — required for the site to work)
• Advertising cookies (Meta Pixel, Facebook Conversions API) — only with your consent
• Analytics cookies (where applicable) — only with your consent

When you visit the site from the EU/EEA/UK, you will see a cookie banner asking for consent before non-essential cookies are loaded. You can change your preferences anytime via the cookie settings link in the footer.

US visitors can opt out of advertising tracking via the same cookie settings.

9. Children's Privacy

Our Services are intended for adults aged 18 and over. We do not knowingly collect personal data from children under 16 (EU) or 13 (US, COPPA). If you believe a child has provided us data, contact us and we will delete it.

10. "Do Not Sell or Share My Personal Information" (California, Colorado, Connecticut, etc.)

Although we do not sell personal information for money, our use of advertising tools like the Meta Pixel may qualify as "sharing" or "targeted advertising" under US state privacy laws.

To opt out:

• Use the cookie settings in our footer to disable advertising cookies, or
• Email us at [email protected] with the subject line "Opt out of sharing", or
• Enable the Global Privacy Control (GPC) in your browser — we honor it automatically.

11. Health and Wellness Disclaimer

The Fullness Reset Method™, the Binge Reset Audio, and any other content offered by MNDD are educational and behavioral coaching tools. They are not medical advice, psychotherapy, or a substitute for professional medical or mental-health care. If you have an eating disorder, mental-health condition, or medical concern, please consult a qualified healthcare provider.

12. Security

We use reasonable administrative, technical, and physical measures to protect your information, including encryption in transit (HTTPS), access controls, and vetted processors. However, no system is 100% secure. If we discover a personal-data breach, we will notify affected users and authorities as required by law.

13. Changes to This Policy

We may update this Policy from time to time. The "Last updated" date at the top reflects the latest version. For material changes, we will notify you by email or through a prominent notice on the site.
